Acceptable Use Policy

This Acceptable Use Policy ("AUP" or "Policy") describes prohibited and restricted uses of the services, platform, APIs, and website offered by Celavii, Inc. ("Celavii," "we," "us," or "our") at celavii.com (collectively, the "Services"). This Policy supplements and is incorporated into the Celavii Terms of Service available at https://celavii.com/terms (the "Agreement").
By accessing or using the Services, you agree to comply with the latest version of this Policy. Violation of this Policy may result in the immediate suspension or termination of your account and access to the Services, without refund.
This Policy applies to all users, including Customers, Authorized Users, and anyone who accesses or uses the Services.
1. General Prohibitions
1.1 Lawful Use Only
You may only use the Services for lawful purposes and in compliance with all applicable local, state, national, and international laws, rules, and regulations. You may not use the Services to:
- Engage in, facilitate, or promote any illegal activity;
- Violate any applicable laws or regulations, including but not limited to data protection, privacy, anti-spam, export control, and consumer protection laws;
- Infringe, misappropriate, or violate the intellectual property, privacy, publicity, or other rights of any third party; or
- Violate the terms of service, privacy policies, or other agreements of any third-party platform or service.
1.2 No Interference with Services
You may not use the Services in any manner that:
- Materially degrades, disrupts, or interferes with the Services or other customers' use of the Services;
- Imposes an unreasonable or disproportionately large load on Celavii's infrastructure;
- Interferes with, disrupts, or creates an undue burden on the servers, networks, or systems connected to the Services; or
- Introduces viruses, malware, Trojan horses, worms, or any other harmful or malicious code or technology.
2. Social Media Data Collection
A core function of the Services involves collecting publicly available data from social media platforms. The following rules apply to all social media data collection activities conducted through the Services:
2.1 Publicly Available Data Only
You may only use the Services to collect data that is publicly available on social media platforms. You may not:
- Attempt to access private, protected, or non-public social media content through the Services;
- Use the Services to circumvent privacy settings, access controls, or authentication mechanisms on any social media platform;
- Collect data from accounts that have been set to private or restricted; or
- Use the Services to access direct messages, private stories, close friends content, or other non-public communications.
2.2 Platform Compliance
You are responsible for ensuring that your use of the Services complies with the terms of service and policies of the social media platforms from which data is collected. You may not:
- Use the Services in a manner that violates the terms of service of Instagram, TikTok, or any other social media platform;
- Collect data at a rate or volume that could result in the disruption of a social media platform's services;
- Use collected data in ways that violate the data use policies of the originating platform; or
- Circumvent rate limits, access restrictions, or technical measures implemented by social media platforms.
2.3 Ethical Data Use
You must use Social Media Data collected through the Services ethically and responsibly. You may not:
- Use collected data to stalk, harass, intimidate, threaten, or harm any individual;
- Use collected data to discriminate against individuals based on race, ethnicity, religion, gender, sexual orientation, disability, age, or any other protected characteristic;
- Compile collected data into dossiers or profiles for the purpose of surveilling, tracking, or monitoring individuals without a legitimate business purpose;
- Sell, license, or distribute raw Social Media Data collected through the Services to third parties, except as expressly permitted by the Agreement;
- Use collected data for purposes unrelated to legitimate creator marketing, brand partnerships, campaign management, or business intelligence; or
- Use collected data to create fake social media accounts, impersonate creators, or engage in identity fraud.
2.4 Creator Rights and Opt-Outs
You must respect the rights of creators and social media users whose data is collected through the Services:
- If a creator requests removal of their data, you must promptly comply or direct the request to Celavii at privacy@celavii.com;
- You may not continue to collect or use data from a creator who has opted out of data collection through Celavii;
- You may not use the Services to contact creators who have previously requested not to be contacted by you; and
- You must comply with all applicable data subject rights requests, including access, correction, and deletion requests.
3. AI Features and Outputs
The Services include AI-powered features such as creator discovery, affinity scoring, lookalike analysis, content analysis, predictive analytics, AI-assisted outreach drafting, and AI Studio (image generation, video generation, and other generative media tools). The following rules apply to your use of AI features:
3.1 Responsible AI Use
You must use AI features responsibly and in accordance with the Agreement. You may not:
- Use AI-generated outputs to deceive, mislead, or defraud any person or entity;
- Present AI-generated content as human-written without appropriate disclosure where required by law or platform policies;
- Use AI features to generate content that is false, misleading, defamatory, or harmful;
- Use AI-generated outreach messages for unsolicited bulk messaging, spam, or any communication that violates anti-spam laws (including CAN-SPAM, CASL, and GDPR direct marketing rules);
- Use AI features to generate content that infringes the intellectual property rights of third parties; or
- Rely on AI-generated outputs as the sole basis for decisions that have material legal, financial, or personal consequences for individuals.
3.2 AI-Assisted Outreach
When using AI-assisted outreach drafting features, you must:
- Review and customize all AI-drafted messages before sending;
- Ensure that all outreach communications comply with applicable anti-spam laws and regulations;
- Include accurate sender identification and a valid opt-out mechanism in all outreach communications;
- Not use AI-assisted outreach to impersonate another person or entity;
- Not send outreach messages to individuals who have previously opted out of communications from you; and
- Maintain reasonable sending volumes and avoid patterns that could be characterized as spam.
3.3 AI Output Accuracy
You acknowledge that AI-generated outputs may contain errors, inaccuracies, or biases. You are solely responsible for:
- Verifying the accuracy of AI-generated insights, recommendations, and analyses before acting on them;
- Ensuring that any AI-generated content you publish or distribute complies with applicable laws and does not contain false or misleading information; and
- Any consequences arising from your use of or reliance on AI-generated outputs.
3.4 No Reverse Engineering
You may not:
- Attempt to reverse engineer, decompile, disassemble, or otherwise determine the source code, algorithms, or underlying models of Celavii's AI features;
- Use the Services to train, develop, or improve competing AI models or services;
- Extract or scrape AI outputs systematically to build competing datasets or services; or
- Probe, test, or exploit vulnerabilities in Celavii's AI features, except as permitted under Celavii's Responsible Disclosure Policy.
3.5 AI Studio and Generative Media
When using AI Studio or any generative media features of the Services (including image generation, video generation, and other generative tools), you must comply with the following additional rules. You may not:
- Deepfakes and non-consensual imagery: Generate, create, or distribute deepfakes, non-consensual intimate imagery, or misleading depictions of real persons;
- Right of publicity and likeness: Generate content depicting any real individual without that person's prior consent, or in a manner that violates their right of publicity, privacy, or likeness;
- Nudity and sexually explicit content: Generate content containing nudity, sexually explicit material, pornography, or content intended to sexually exploit or arouse;
- Violence and harmful content: Generate content depicting graphic violence, gore, torture, or content that promotes self-harm, suicide, or harm to others;
- Minors: Generate any content depicting, involving, or targeting minors in any inappropriate, sexual, violent, or exploitative context;
- Biometric data: Process biometric data (such as facial geometry, voiceprints, or other biometric identifiers) through AI Studio without proper consent as required by applicable law, including the Illinois Biometric Information Privacy Act (BIPA), Texas CUBI Act, and similar statutes;
- Fraud and impersonation: Use AI-generated content to impersonate real persons or entities, create fraudulent documents or credentials, or deceive others about the origin or authenticity of content;
- Intellectual property infringement: Intentionally generate content that reproduces copyrighted works, trademarks, logos, or other protected intellectual property of third parties without authorization;
- Competing AI training: Use AI Outputs generated through AI Studio to train, develop, fine-tune, or improve any artificial intelligence or machine learning models, algorithms, or products that compete with Celavii's Services;
- Automated mass generation: Use automated tools, scripts, or bots to generate AI content at scale for the purpose of creating spam, flooding platforms, or overwhelming content moderation systems; or
- Misrepresentation of AI content: Present AI-generated images, videos, or other media as authentic photographs, real footage, or human-created content where such misrepresentation could deceive a reasonable person, without appropriate disclosure that the content was AI-generated.
You are solely responsible for obtaining all necessary rights, consents, releases, and permissions related to AI Inputs you submit and AI Outputs you use, publish, or distribute. This includes, without limitation, rights related to intellectual property, privacy, and publicity.
3.6 Agentic Features
The Services include AI-powered autonomous agents ("Agents") that can perform actions on your behalf. The following rules apply to your use of Agents:
- Supervision required: You must regularly monitor and review Agent actions. You are responsible for maintaining appropriate human oversight of all Agent activity;
- Compliance responsibility: All actions taken by an Agent are deemed your actions. You must ensure Agent actions comply with all applicable laws, including anti-spam, marketing, data protection, and electronic communications laws;
- No circumvention: You may not use Agents to circumvent rate limits, usage restrictions, spending limits, or other controls implemented by the Services or by third-party platforms;
- No harmful automation: You may not configure Agents to engage in bulk harassment, mass unsolicited outreach, stalking, intimidation, or other harmful behavior;
- No deceptive practices: You may not use Agents to impersonate real persons, create fake engagement, or engage in astroturfing or other deceptive marketing practices;
- Credit responsibility: You are responsible for all Credit consumption by Agents, including Overages. You should configure appropriate spending limits and monitor Agent Credit usage; and
- Prompt intervention: If you become aware that an Agent is taking unintended, harmful, or non-compliant actions, you must promptly intervene to stop such actions and notify Celavii if the actions may have caused harm to third parties.
3.7 Communication Gateways
The Services may enable you to interact with the platform through third-party communication platforms such as WhatsApp, Telegram, Discord, and email ("Communication Gateways"). The following rules apply:
- Platform compliance: You must comply with the terms of service, acceptable use policies, and community guidelines of each third-party communication platform you use as a Communication Gateway. This includes but is not limited to the WhatsApp Business Policy, Telegram Terms of Service, and Discord Developer Terms of Service;
- No spam or bulk messaging: You may not use Communication Gateways to send unsolicited bulk messages, spam, or automated marketing messages to individuals who have not consented to receive them;
- Anti-spam law compliance: All messages sent through Communication Gateways must comply with applicable anti-spam and electronic communications laws, including CAN-SPAM, TCPA, GDPR, CASL, and the ePrivacy Directive;
- Opt-out compliance: You must honor all opt-out, unsubscribe, and do-not-contact requests received through Communication Gateways. You may not continue to send messages to individuals who have opted out;
- No impersonation: You may not use Communication Gateways to impersonate Celavii, other users, or third parties;
- Authorized accounts only: You may only link communication accounts that you own or are authorized to use. You may not link accounts belonging to third parties without proper authorization;
- Data protection: You are responsible for ensuring that your use of Communication Gateways complies with applicable data protection laws, including obtaining any necessary consents for processing personal information through third-party platforms;
- No platform abuse: You may not use Communication Gateways in a manner that could result in the suspension, termination, or restriction of Celavii's or other customers' access to the underlying third-party platform; and
- Content responsibility: You are solely responsible for the content of all messages sent and received through Communication Gateways, whether initiated by you, an Authorized User, or an Agent.
4. Account and Access
4.1 Account Security
You are responsible for maintaining the security of your account. You may not:
- Share account credentials with unauthorized individuals;
- Use another user's account without authorization;
- Create accounts using false or misleading information;
- Use temporary, disposable, or fraudulent email addresses for your account;
- Create multiple accounts to circumvent limitations, restrictions, or enforcement actions; or
- Circumvent a suspension or termination by creating a new account or using another person's account.
4.2 Automated Access
You may not access the Services through automated means (including bots, scrapers, or scripts) except:
- Through Celavii's officially documented APIs, in compliance with any applicable rate limits and usage policies; or
- As expressly authorized in writing by Celavii.
4.3 Workspace Integrity
If you access the Services through a Workspace, you must:
- Comply with the access controls and permissions configured by the Workspace administrator;
- Not attempt to access data, features, or areas of the Services outside your authorized scope;
- Not share or export data from a Workspace in violation of the Workspace administrator's policies or the Agreement; and
- Report any unauthorized access to your Workspace to Celavii immediately.
5. Content and Communications
5.1 Prohibited Content
You may not use the Services to create, store, transmit, or distribute content that:
- Is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable;
- Constitutes or promotes child sexual abuse material (CSAM) or the exploitation of minors;
- Promotes violence, terrorism, extremism, or hateful behavior targeting individuals or groups;
- Contains or distributes malware, viruses, or other harmful technology;
- Infringes the copyright, trademark, trade secret, or other intellectual property rights of any third party;
- Violates the privacy or publicity rights of any individual; or
- Is designed to deceive, defraud, or mislead;
- Consists of AI-generated deepfakes, non-consensual synthetic imagery, or AI-generated content depicting real individuals without their consent; or
- Is AI-generated content that is presented as authentic or human-created in a manner intended to deceive, where applicable law or platform policies require disclosure of AI involvement.
5.2 Spam and Unsolicited Communications
You may not use the Services to:
- Send, facilitate, or promote unsolicited bulk communications (spam);
- Distribute chain letters, pyramid schemes, or multi-level marketing communications;
- Harvest or collect email addresses or contact information for the purpose of sending unsolicited communications; or
- Alter message headers, sender information, or other metadata to obscure the origin of communications.
6. Security and Network Integrity
6.1 Unauthorized Access
You may not:
- Attempt to probe, scan, or test the vulnerability of the Services or any related system or network, except as permitted under Celavii's Responsible Disclosure Policy;
- Attempt to breach or circumvent any security or authentication measures of the Services;
- Access, tamper with, or use non-public areas of the Services, Celavii's systems, or the technical delivery systems of Celavii's providers; or
- Attempt to gain unauthorized access to any other user's account, data, or systems.
6.2 Denial of Service
You may not execute, attempt to execute, or facilitate a Denial of Service (DoS) or Distributed Denial of Service (DDoS) attack against the Services or any related system.
6.3 Data Integrity
You may not:
- Modify, delete, or corrupt data belonging to other users or customers;
- Interfere with the proper functioning of the Services, including by introducing malicious code;
- Use the Services as infrastructure for attacks against third-party systems or networks; or
- Use the Services for cryptocurrency mining, proxy services, or other resource-intensive activities not related to the intended purpose of the Services.
7. Financial Crime and Regulated Activities
7.1 Financial Fraud
You may not use the Services to:
- Engage in card testing, card verification, or the storage of stolen financial data;
- Facilitate money laundering, terrorist financing, or other financial crimes;
- Engage in or facilitate fraudulent schemes, including Ponzi schemes, pyramid schemes, or advance-fee fraud; or
- Process, store, or transmit payment cardholder data through the Services without Celavii's prior written approval.
7.2 Regulated Activities
You may not use the Services for:
- Activities that require specific licenses or regulatory approvals that you do not possess;
- The sale or distribution of controlled substances, drug paraphernalia, or illegal goods;
- Unregulated gambling or wagering activities; or
- High-risk systems where failure could lead to death or catastrophic damage (e.g., nuclear facilities, aircraft navigation, life support systems).
8. Monitoring and Enforcement
8.1 Investigation and Action
Celavii reserves the right, in its sole discretion, to:
- Monitor use of the Services for compliance with this Policy;
- Investigate any suspected violation of this Policy;
- Remove or disable access to any content that violates this Policy;
- Suspend or terminate any account that violates this Policy, with or without notice;
- Report suspected illegal activity to law enforcement, regulatory authorities, or other appropriate third parties; and
- Cooperate with law enforcement investigations, which may include disclosing relevant customer information.
8.2 No Obligation to Monitor
Celavii has no obligation to monitor user content or activity and does not assume responsibility for user-generated content. However, Celavii may choose to monitor at any time at its sole discretion.
8.3 Remedies
Violation of this Policy may result in:
- Warning or notice of the violation;
- Temporary suspension of access to the Services;
- Permanent termination of the account and access to the Services;
- Removal of offending content or data;
- Forfeiture of unused credits or prepaid fees; and/or
- Legal action, including claims for damages and injunctive relief.
Celavii's remedies under this Policy are in addition to, and not in lieu of, any other rights or remedies available to Celavii under the Agreement or applicable law.

Please include as much detail as possible, including the nature of the violation, any relevant URLs or account information, and any supporting evidence.
10. Changes to This Policy
Celavii may update this Acceptable Use Policy from time to time. We will notify you of material changes by updating the "Last Modified" date at the top of this Policy and, where appropriate, providing notice through the Services or by email. Your continued use of the Services after the effective date of the revised Policy constitutes your acceptance of the changes.
